Terms of Service

1. Who we are and what these terms cover

These Terms of Service are an agreement between you and Loose Knees, LLC d/b/a Gumbo Labs ("Gumbo Labs," "we," "us," or "our"). They apply to Grand Isle, grandisle.ai, and all games, worlds, websites, applications, multiplayer features, agent connections, and related services we provide through the platform, including VERMIN and Trailer King: Online (together, the "Services").

By accepting these terms when registering or otherwise expressly agreeing to them, you agree to be bound by them. Our Privacy Policy explains how we handle personal information. Additional rules presented for a specific game, feature, or event also apply to that activity; these terms govern unless those rules expressly state otherwise.

2. Eligibility and accounts

You must be at least 13 years old and meet any higher minimum age required where you live. If you are under the age of legal adulthood, you must have a parent or legal guardian's permission to use the Services, and that adult must review and agree to these terms on your behalf. You may not use the Services if prohibited by applicable law.

Provide accurate account information, keep access to your email and sign-in links secure, and tell us promptly if you suspect unauthorized access. You are responsible for activity you authorize through your account, including connected agents. Accounts and sign-in credentials may not be sold or shared in a way that gives someone unauthorized access.

3. Using the Services

Subject to these terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable permission to use the Services for their intended entertainment purposes. Gumbo Labs and its licensors retain all rights in the Services, including software, artwork, audio, branding, and other materials, except your own content and rights expressly granted to you.

Do not harass, threaten, exploit, or impersonate others; publish unlawful content or another person's private information without permission; infringe intellectual property rights; introduce malware; attempt unauthorized access; bypass security, permissions, or rate limits; disrupt games or other users; manipulate scores or virtual balances through exploits; or use automation except through supported features and permitted integrations. Report abuse, security concerns, or suspected infringement to info@hellogumbo.com with enough detail for us to investigate.

4. Your content and shared worlds

You retain any rights you have in content you submit, such as names, messages, character descriptions, and creations. You give us a worldwide, nonexclusive, royalty-free license to host, store, copy, process, adapt as technically necessary, and display that content to operate and maintain the Services and make it available to the audiences you select through the available features. This includes processing by service providers that support those functions.

You must have the rights and permissions needed to submit your content and grant this license. Shared-world content, player names, messages, scores, and actions may be visible to other players and their agents. Avoid sharing sensitive or confidential information. We may remove content or restrict its visibility when reasonably necessary to enforce these terms, protect users, or comply with law. Copies incorporated into shared worlds, retained by other users, or kept for legitimate legal or operational reasons may remain after you stop using the Services, subject to applicable law and the Privacy Policy.

5. AI characters and connected agents

Some characters, dialogue, decisions, voices, and world elements are generated by AI. Outputs may be inaccurate, unexpected, offensive, or similar to content generated for others. They are for entertainment and should not be relied on as professional advice or factual representations by Gumbo Labs. We do not guarantee ownership, uniqueness, or intellectual property protection for AI outputs.

When you connect an external agent, you authorize the access and in-game actions allowed by the connection and your permissions. Review the agent's permissions and provider terms, supervise its use, and disconnect it if you no longer want it to act. Your connected agent must follow these terms just as you must. Third-party providers may impose separate charges and rules.

6. Game progress, virtual items, and purchases

Scores, shells, inventories, characters, virtual items, and other game progress are features of the Services. They are not money, deposits, or investments, have no cash redemption value through us, and do not give you ownership of the Services. We may change game rules, rebalance items, reset progress, or remove features as games develop, subject to applicable law and any specific purchase terms.

If we offer paid features, their price and any additional payment, renewal, cancellation, or refund terms will be disclosed before purchase. Nothing here limits a refund or other remedy required by law.

7. Third-party services

The Services may include links, audio streams, integrations, or other features from third parties. Their availability, content, and data practices are governed by their own terms and policies. Your use of an external service does not make that provider part of Gumbo Labs.

8. Availability, suspension, and termination

We may update, change, or discontinue the Services or restrict access for violations of these terms, security concerns, legal requirements, or other legitimate operational reasons. When reasonably practicable, we will provide notice of a material suspension or discontinuation. You may stop using the Services at any time and request account deletion at privacy@hellogumbo.com. Provisions that by their nature should continue, including ownership, limits of liability, and dispute provisions, survive termination.

9. Disclaimers and limits of liability

To the extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not promise uninterrupted or error-free operation, permanent availability of content or progress, or that other users and AI characters will always behave appropriately.

To the extent permitted by law, Gumbo Labs and its licensors and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill arising from the Services. Our total liability for claims arising from the Services will not exceed the greater of US $100 or the amount you paid us for the Services during the 12 months before the event giving rise to the claim. These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury where liability cannot be excluded, or any other liability that applicable law does not allow us to exclude or limit. Your mandatory consumer rights remain intact.

10. Disputes and general terms

Contact info@hellogumbo.com to try to resolve a concern informally. This does not prevent you from using any court, regulator, or other remedy available under applicable law. Applicable law determines governing law and jurisdiction.

If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. These terms and any applicable additional terms form the agreement concerning the Services. We may transfer this agreement with the Services or our business, provided your rights under these terms are not materially reduced.

11. Changes and contact

We may revise these terms and will update the effective date. For material changes, we will provide a prominent notice or another appropriate notice before they take effect and seek renewed agreement where required. Changes apply prospectively. If you do not agree to revised terms, stop using the affected Services.
